Statement of Privacy

LifeFiles is committed to private and confidential communications between family members and those friends and relatives touched by an end-of-life event...people we call members of the Affected Circle. We are also sensitive to concerns about preserving the privacy of LifeFiles visitors, our Network Members and their customers.

If you choose to use our referral service to tell a friend about our site, we will ask you for your friend's name and email address. We will automatically send your friend a one-time email inviting him or her to visit the site. LifeFiles.com uses this information for the sole purpose of sending this one-time email and tracking the success of our referral program.

Personal Identifying Information

Visitors to LifeFiles will have the opportunity to link to our Network Members, as well as LifeFiles Remembrance Seriessm products and services. Visitors who purchase products or services are requested to provide certain personal information, e.g. name, address, email address, zip code, and fax number ("Personal Identifying Information") and such other relevant data as may be required from a family to create a Remembrance Registrysm or LifeLegacysm. This Personal Identifying Information and other relevant data may be collected in the LifeFiles Advisor, the LifeLegacy creation pages, the Admin Page of a Network Member, or on the Family Admin Page. All Personal Identifying Information that we collect will be used to help fill your requests for products and/or services. Neither LifeFiles nor its Network Members will otherwise contact you unless you request us to, whether for support, product information, or other matters.

When making an entry into the Guestbook or Sharing Memory sections of a Remembrance Registrysm and/or LifeLegacysm, your email address will be available to viewers of those areas by clicking on your name. This is done for the purpose of allowing friends and family to reconnect, communicate and share their thoughts of a loved one. If the site is password protected, the email is available to only those with password access to the site.

When a user purchases a product from LifeFiles, we will collect the appropriate financial and billing information. This information is not stored by the LifeFiles system. When a visitor enters www.LifeFiles.com our Internet Service Provider collects information such as IP address (your computer's unique signature), visiting domain information, and browser type. This information is used to test the effectiveness of our marketing campaigns and to provide better service to LifeFiles users.

The LifeFiles LifeLegacysm is a unique and interactive living memorial that helps families and loved ones connect, communicate and celebrate life. The LifeLegacysm incorporates biographical information about the deceased, which may include medical, legal or educational information. LifeFiles does not collect such data for commercial use and, at the option of the family, access to this and other biographical information can be restricted by creating a "password protected" LifeLegacysm. This information is stored on our site as part of the LifeLegacy, and friends and loved ones may view such information (with password, if required).

Any database of Personal Identifying Information and other relevant information collected by Network Members and LifeFiles is, and will remain, the joint property of LifeFiles and the originating Network Members. No Personal Identifying Information will be revealed or sold to anyone without the consent of the visitor.

This site makes chat rooms, forums, message boards, and/or news groups available to its users. Please remember that any information that is disclosed in these areas become public information and you should exercise caution when deciding to disclose your personal information.

Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on our Web site.

"Opt-in" or Permission-Based Marketing

LifeFiles is committed to the privacy of its visitors. Therefore, LifeFiles is a proponent of "opt-in" marketing. This form of marketing puts the user in complete control of whether he/she will view or receive information about, or elect to purchase, a product or service. Visitors to www.LifeFiles.com will not be confronted with unsolicited advertising or marketing material. www.LifeFiles.com utilizes "opt-in" features. When a visitor to www.LifeFiles.com voluntarily elects to receive information on one or more subjects, he/she will click on the subject matter and receive an email or information from a provider selected by LifeFiles. If at a later date the visitor wants to stop receiving information from a provider, he/she can unsubscribe (i.e. "opt-out") by email. Visitors to a Network Member's Web site will be able to access this "opt-in" feature by clicking on the LifeFiles component of the Web site and going to the LifeFiles Advisor. All "opt-in" marketing data collected from visitors by www.LifeFiles.com remains the property of LifeFiles and the requested interested provider(s).

Information provided by a visitor to the LifeFiles Advisor, or otherwise provided in his/her voluntary pursuit of other "opt-in" opportunities at www.LifeFiles.com, constitutes permission-based marketing data and LifeFiles will use it only for the specific purpose indicated by the visitor. By voluntarily participating in the "opt-in" features, the visitor consents to the use of this data, including Personal Identifying Information, for the intended purpose of the "opt-in" opportunity.

In addition to these "opt-in" opportunities, visitors who purchase a Remembrance Registrysm or LifeLegacysm on a Network Member's Web site or from www.LifeFiles.com, will be given the option to "click thru" and buy products and services from third party vendors pursuant to affiliate arrangements with www.LifeFiles.com. Books, greeting cards and flowers are examples of this e-commerce component. In addition, these visitors can elect to make a donation to the charity of his/her choice, or the charity designated by the family. The third party vendors are obligated to provide LifeFiles with information about aggregate purchases of their products through Network Members' Web sites for posting to the Members' Admin Pages. No Personal Identifying Information is provided by third party vendors to LifeFiles. Information collected by these third party vendors is the property of the vendors, LifeFiles and Network Members. Each can use the information for its own purposes, subject to their privacy policies.

When a visitor follows a link from www.LifeFiles.com and enters the Web site of a Network Member or a third party vendor, the visitor is subject to the privacy policy of that site. The LifeFiles privacy policy does not apply on these sites. In addition, www.LifeFiles.com has a policy against the use cookies. A cookie is a piece of text that a web server can store on a user's hard disk. Cookies allow a web site to store information on a user's machine and later retrieve it. Should you experience a browser alert when on our site, it is merely signifying the tracking of usage to a particular Network Member or to LifeFiles and is for administrative purposes only. No Personal Identifying Information is collected by this activity.
